Aug 26, 2020 at 10:41 comment added Reb Chaim HaQoton Looks like I found a version of this in הגהות רבי אלעזר משה הורוביץ to Kiddushin 2b.

Mar 7, 2019 at 2:53 comment added Menachem @DoubleAA I'm pretty sure the Gemara has a story of malkos (specifially, makos mardus) for a חתן שבא על אריסתו בבית אביה, so I don't see how anyone would be mechayev misa. At any rate, it should be no more severe than the issur of a penuya.
Feb 5, 2019 at 17:08 comment added Double AA @yosef ok well let's wait and see if user15464 comes up with anything. I'm quite sure it's in there somewhere.
Feb 5, 2019 at 17:04 comment added yosefkorn @doubleaa I just used the Sefaria app for the Gemora quoted in the answer but I haven't checked the whole shittah mekubetzes though I think it's unlikely to find about this sugia elswhere
Feb 5, 2019 at 14:35 comment added Double AA @yosefkorn That's some fast reading! Maybe user15464 will be able to find it
Feb 5, 2019 at 1:55 comment added MDjava It's an Abudraham, who himself rejects it.
Feb 4, 2019 at 23:03 comment added yosefkorn @doubleaa looked through the shittah mekubetzes and nothing about the husband getting killed. Though it could be that he's Chayav misah for transgressing a rabbinical enactment bidei shamayim
Feb 4, 2019 at 22:58 comment added Double AA No that's not it. It's explicit he gets killed
Feb 4, 2019 at 22:57 comment added yosefkorn @doubleaa if you mean this Shita mekubetzes in the name of the Rashba :ש"מ דלא קניא לה לגמרי הילכך הויא לה כארוסת אחר לגביה ואסירא ליה כדין אשת איש -she is not fully acquired yet and she is similar to a wife of another and hence prohibited to her husband similar to an Eishes ish. This is all mideranan as the Rashba clearly states in his commentary אף על גב דחופה דאורייתא לענין נדרים ולענין קטלה, מכל מקום לענין התר ביאה מכיון שנתקדשה הרי היא קנוייה לו לבעל ומותרת לו מעתה
Feb 4, 2019 at 21:18 comment added Double AA I think it's in the Shittah Mekubbetzet in Ketubbot.
Feb 4, 2019 at 20:59 comment added user15464 @DoubleAA this would be interesting if you could provide a source
Feb 4, 2019 at 20:51 comment added Double AA Some Rishonim disagree and think if the husband sleeps with his Arusa he gets killed, clearly implying the prohibition is biblical
