Many ideas in Judaism retain their duality - we treat them as A for situation X and as B (or not A) for Y. A great example of such "Musar" ruling of Rambam is (T"T 3,10) - "כל המשים על לבו שיעסוק בתורה ולא יעשה מלאכה ויתפרנס מן הצדקה הרי זה חלל את השם ובזה את התורה וכבה מאור הדת וגרם רעה לעצמו ונטל חייו מן העולם הבא " - please see what K"M says about that!
Jun 27, 2018 at 19:16 comment added Al Berko Another point on Rambam's contradictions: Many times Rambam follows the language of a certain Gemmorah dealing with the specific Sugya. Look at the Kesef Mishne or other Meforshim where did he take it - you'll see the original Gemmorah stories are somewhat contradicting and Rambam simply cites them almost literally.

Jun 27, 2018 at 17:38 comment added Al Berko I can also generalize that principle to the Chachamim of the Talmud also, that many Takanot were ruled in Musar terms (הנהגה טובה, לפני משוה"ד, להרחיק אדם מן העבירה etc) and it took generations until they turned into Halachah.

Jun 27, 2018 at 17:36 comment added Al Berko I'm just saying that expressions of a "Musar" type can not be seriously contrasted in Rambam. I stumbled many times over such statements and my only explanation to Rambam's slight "exaggerations" is that he not only teaches Halacha but also Musar.
Jun 27, 2018 at 17:19 comment added Alex @AlBerko The only quote here from Sefer Hamada is the one from Hilchot Teshuvah, and Rambam references that halacha in Hilchot Shechitah which is not in Sefer Hamada.
Jun 27, 2018 at 17:11 comment added Al Berko You need to understand something about Mishne Torah (my personal conclusions): just like the Talmud is not a strictly Halachic book, Rambam's Mishne Torah is not a strictly Halachic book it is full of parables, personal stands and moral guidance. Especially Sefer Hamada, that similar to Moreh Navochim, is more of a Musar book and can not be compared Halachicly wise with other books of MT.
