You know, this Shach doesn't necessarily represent the opinion of the Shulhan Aruch. You notice, he quotes the Tosfafot and the Rosh, but that doesn't mean Maran accepts that opinion. As you said before צ"ע. According to Ashkenazim it would be Mutar, and those Sephardim who follow the Ben Ish Hai it may also seem to be Mutar.
